The plaintiff sought to set aside a resolution adopted at the condominium owners’ meeting on 12 September 2017 under agenda item 3. Following an oral hearing on 22 October 2018, Düsseldorf Local Court dismissed the challenge. It allocated 62% of the proceedings’ costs to the plaintiff and 38% to the defendants. The judgment was declared provisionally enforceable against security of 110% of the amount to be enforced.

Das Urteil ist gegen Sicherheitsleistung in Höhe von110 % des Vollstreckungsbetrages vorläufig vollstreckbar.
