The respondent challenged the Düsseldorf Local Court's 8 January 2018 order imposing an order fine. The Local Court modified that order, setting the fine at EUR 1,500, but held that the remaining objections did not warrant further relief; it therefore forwarded the matter to the Düsseldorf Higher Regional Court. Der Beschluss des Amtsgerichts Düsseldorf vom 08.01.2018 wird dahingehend abgeändert, dass gegen den Antragsgegner ein Ordnungsgeld von 1.500 EUR festgesetzt wird.
Im Übrigen greifen die Einwände gegen den Beschluss vom 08.01.2018 nicht durch, so dass der sofortigen Beschwerde insoweit nicht abzuhelfen und die Sache dem Oberlandesgericht Düsseldorf zur Entscheidung vorzulegen war.
Der Antrag auf Aussetzung der Vollziehung des Ordnungsgeldbeschlusses vom 06.02.2018, auszulegen als Antrag nach § 93 Abs. 1 Satz 1 Nr. 4 FamFG, wird zurückgewiesen.
