In this order, the Düsseldorf Local Court stayed the proceedings and referred a question to the CJEU under Article 267 TFEU. The question concerns a single travel booking involving one or more direct connecting flights and the distance used to calculate compensation under Article 7 of Regulation 261/2004. Dem Gerichtshof der Europäischen Union wird gemäß Art. 267 AEUV folgende Frage zur Auslegung des Unionsrechts vorgelegt:

Kommt es im Falle einer Durchführung einer Luftbeförderung aufgrund einer einheitlich Reisebuchung mit einem oder mehreren direkten Anschlussflügen zum Endziel für die Ermittlung der maßgeblichen Entfernung für die Bemessung eines Entschädigungsanspruchs nach Art. 7 Abs. 1 EG VO 261/04 gem. Art. 7 Abs. 4 EG VO 261/04 auf die

  • nach der Großkreismethode ermittelte Entfernung zwischen dem Startort des ersten Flugabschnitts und dem Endziel
  • nach der Großkreismethode ermittelte Entfernung zwischen dem Startort des gestörten Flugabschnitts und dem Endziel
  • nach der Großkreismethode ermittelte Entfernung zwischen dem Endziel und dem von diesem am weitesten entfernten Abflugort eines von mehreren Flugabschnitten
  • oder nach der Großkreismethode ermittelte Entfernung unter Addition der Entfernungen zwischen den Start- und Zielorten der einzelnen Flugabschnitte
