Tenor

Die Beklagte wird verurteilt, an den Kläger 3.836,96 EUR nebst Zinsen aus 3.250,00 EUR in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem 07.02.2012 sowie 359,50 EUR nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem 07.02.2012 zu zahlen.

Die Beklagte trägt die Kosten des Rechtsstreits.

Das Urteil ist gegen Sicherheitsleistung in Höhe von 110 % des jeweils zu vollstreckenden Betrages vorläufig vollstreckbar.
