The Düsseldorf Local Court ruled on the plaintiff’s challenge to a condominium owners’ resolution adopted under agenda item 3 on 5 June 2012. It declared the resolution null and void and ordered the defendants to bear the costs of the proceedings. Tenor

Es wird festgestellt, dass der in der Eigentümerversammlung vom 05.06.2012

zum Tagesordnungspunkt 3 gefasste Beschluss nichtig ist.

Die Kosten des Rechtsstreits tragen die Beklagten.

Das Urteil ist vorläufig vollstreckbar.

Den Beklagten wird nachgelassen, die Vollstreckung durch die Klägerin durch

Sicherheitsleistung in Höhe von 110 % des zu vollstreckenden Betrages abzu-

wenden, wenn nicht die Klägerin vor der Vollstreckung Sicherheit in gleicher

Höhe leisten.
