Es wird festgestellt, dass die Beklagte verpflichtet ist, den Klägern Deckung für die gerichtliche Geltendmachung von Schadensersatzansprüchen gegen die Versicherergemeinschaft für das wirtschaftliche Prüfungs- und Treuhandwesen, E-Str. 00, X, wegen Deckung eines Versicherungsfalles ihres Versicherungsnehmers Wirtschaftsprüfers G wegen vorvertraglicher Pflichtverletzung aus der Beteiligung der Kläger an der G1 GbR vom 05.11.2003 in Höhe von 5.000,00 EUR zu gewähren.
Die Kosten des Rechtsstreits trägt die Beklagte.
Das Urteil ist im Kostenpunkt vorläufig vollstreckbar. Die Beklagte kann die Zwangsvollstreckung durch die Kläger gegen Sicherheit in Höhe von 110 % des vollstreckbaren Betrages abwenden, wenn nicht zuvor diese Sicherheit in gleicher Höhe leisten.
Der Streitwert wird auf bis 5.000,00 EUR festgesetzt.
