The plaintiff sued the defendant for payment. Following an oral hearing on 19 March 2009, Düsseldorf Local Court ordered the defendant to pay €800.88 with interest from 3 October 2007 and €124.36 in pre-litigation costs with interest from 16 November 2007. The remainder of the claim was dismissed. The court allocated the costs of the proceedings 46% to the plaintiff and 54% to the defendant. The judgment was declared provisionally enforceable, subject to security provisions.

Tenor

für Recht erkannt:

Die Beklagte wird verurteilt, an den Kläger 800,88 Euro nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem 03.10.2007 sowie vorgerichtliche Kosten in Höhe von 124,36 Euro nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem 16.11.2007 zu zahlen.

Im Übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits trägt der Kläger zu 46 % und die Beklagte zu 54 %.

Das Urteil ist vorläufig vollstreckbar. Die Parteien können die Vollstreckung durch den jeweils anderen durch Sicherheitsleistung in Höhe von 119 % des jeweils zu vollstreckenden Betrags abwenden, wenn nicht zuvor der jeweils andere Sicherheit in gleicher Höhe leistet.
