Tenor

hat das Amtsgericht Düsseldorf

im schriftlichen Verfahren unter Berücksichtigung der bis zum 30.7.2008 gewechsel-ten Schriftsätze der Parteien

durch den Richter am Amtsgericht X

für R e c h t erkannt:

Die Beklagte wird unter Abweisung der Klage im Übrigen verurteilt, an den Kläger 186,52 € nebst Zinsen in Höhe von 5 Prozentpunkten über dem Ba-siszinssatz seit dem 31.5.2007 zu zahlen.

Die Beklagte trägt die Kosten des Rechtsstreits.

Das Urteil ist vorläufig vollstreckbar.

Von der Darstellung des Tatbestandes wird gemäß § 313 a ZPO abgesehen.
