Following an oral hearing on 12 June 2008, Düsseldorf Local Court set aside its preliminary judgment of 28 February 2008, dismissed the claimant’s action, and granted the defendant’s counterclaim. The claimant was ordered to pay €1,548.50, with interest at five percentage points above the base rate on €1,392 from 1 December 2005 and on €156.50 from 29 May 2008. The claimant was also ordered to bear the costs. The judgment is provisionally enforceable against security of 120% of the amount to be enforced.

für R e c h t erkannt:

Das Vorbehaltsurteil des Amtsgerichts Düsseldorf vom 28.02.2008 (51 C 9278/07) wird aufgehoben.

Die Klage wird abgewiesen.

Auf die Widerklage wird die Klägerin verurteilt, an den Beklagten 1.548,50 EUR nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz aus 1.392,- EUR seit dem 01.12.2005 und aus 156,50 EUR seit dem 29.05.2008 zu zahlen.

Die Klägerin hat die Kosten des Rechtsstreits zu tragen.

Das Urteil ist gegen Sicherheitsleistung in Höhe von 120 % des jeweils zu vollstreckenden Betrages vorläufig vollstreckbar.
