In this first-instance condominium dispute, the Düsseldorf District Court declared invalid the resolutions adopted under agenda item 4 at the owners’ meeting of 28 April 2007. It rejected the application in all other respects. Court costs were allocated 10.5% each to participants 1 and 2, and 39.5% each to participants 3 and 4; no extrajudicial costs were reimbursed. The court set the value in dispute at EUR 11,404, comprising EUR 2,407.06 for agenda item 3 and EUR 9,000 for agenda item 4.

Tenor

Die unter Tagesordnungspunkt 4 der Eigentümerversammlung vom 28.04.07 gefassten Beschlüsse werden für ungültig erklärt.

Im Übrigen wird der Antrag zurückgewiesen.

Von den Gerichtskosten des Verfahrens tragen die Beteiligten zu 1. und 2. je 10,5 % und die Beteiligten zu 3. und 4. je 39,5 %.

Die Erstattung außergerichtlicher Kosten findet nicht statt.

Der Geschäftswert wird auf 11.404,-- Euro (2.407,06 zu Top 3 und 9.000,-- Euro zu Top 4) festgesetzt.
