The District Court Düsseldorf, sitting in written proceedings, issued a final judgment on 13 February 2007. It confirmed without reservation its earlier reservation judgment of 5 September 2005 and additionally ordered the defendant to pay the plaintiff €1,183.20, with interest at eight percentage points above the applicable base rate from 11 February 2006. The defendant was also ordered to bear the costs. The judgment is provisionally enforceable, subject to security provisions allowing the defendant to avert enforcement by providing security or making a deposit equal to 110% of the enforceable amount, unless the plaintiff first provides security in the same amount.

Tenor

hat das Amtsgericht Düsseldorf

im schriftlichen Verfahren mit einer Erklärungsfrist bis zum 05.02.2007

durch die Richterin am Amtsgericht X

für Recht erkannt.

Das Vorbehaltsurteil vom 05.09.2005 wird unter Wegfall des Vorbehalts

bestätigt. der Beklagte wird darüber hinaus verurteilt, an die Klägerin

1.183,20 € zzgl. Zinsen in Höhe von 8 Prozentpunkten über dem jeweils

gültigen Basiszinssatz seit dem 11.02.2006 zu zahlen.

Die Kosten des Rechtsstreits trägt der Beklagte.

Das Urteil ist vorläufig vollstreckbar. Der Beklagte darf die Vollstreckung durch

Sicherheitsleistung oder Hinterlegung in Höhe von 110 % des aufgrund des Urteils

vollstreckbaren Betrages abwenden, wenn nicht die Klägerin vor der Vollstreckung

Sicherheit in gleicher Höhe leistet.
