After an oral hearing on 5 May 2006, Düsseldorf Local Court partially upheld the plaintiff’s payment claim against the defendants. The defendants were ordered jointly and severally to pay €3,331.50, together with interest on €1,831.50 at five percentage points above the applicable base rate from 12 February 2005. The remaining claim was dismissed. The court allocated one third of the proceedings’ costs to the plaintiff and two thirds jointly and severally to the defendants. It also made the judgment provisionally enforceable subject to security conditions.

Tenor

hat das Amtsgericht Düsseldorf

auf die mündliche Verhandlung vom 5.5.2006

durch den Richter am Amtsgericht X

für R e c h t erkannt:

Die Beklagten werden als Gesamtschuldner verurteilt, an den Kläger 3.331,50 € nebst Zinsen aus 1.831,50 € in Höhe von 5 Prozentpunkten über dem jeweiligen Basiszinssatz seit dem 12.2.2005 zu zahlen.

Im Übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits werden dem Kläger zu 1/3 und den Beklagten als Gesamtschuldnern zu 2/3 auferlegt.

Das Urteil ist vorläufig vollstreckbar, für den Kläger jedoch nur gegen Sicherheitsleistung in Höhe des jeweils zu vollstreckenden Betrages.

Der Kläger kann die Vollstreckung gegen Sicherheitsleistung in Höhe des jeweils zu vollstreckenden Betrages abwenden, wenn die Beklagten nicht vor der Vollstreckung in gleicher Höhe Sicherheit leisten.
