Die Klage wird abgewiesen.
Die Kosten des Rechtsstreits trägt der Kläger.
Das Urteil ist vorläufig vollstreckbar. Der Kläger kann die Zwangsvollstreckung durch die Beklagte gegen Sicherheitsleistung in Höhe von 110 % des zu vollstre-ckenden Betrages abwenden, sofern die Beklagte vor der Vollstreckung nicht Si-cherheit in gleicher Höhe leistet.
Die Sicherheitsleistung kann auch durch die selbstschuldnerische Bürgschaft ei-ner deutschen Bank oder Sparkasse erbracht werden.
