für R e c h t erkannt:

Die Beklagte wird verurteilt, an den Kläger 319,77 EUR nebst 5 Prozentpunkten Zinsen über dem Basiszinssatz seit dem 13.12.2005 sowie 40,72 EUR vorgerichtliche, nicht anrechenbare Anwaltskosten zu zahlen.

Die Kosten des Rechtsstreits werden der Beklagten auferlegt.

Das Urteil ist vorläufig vollstreckbar.
