hat das Amtsgericht Düsseldorf

aufgrund der mündlichen Verhandlung vom 6.12.2004

durch die Richterin X

für R e c h t erkannt:

Der Beklagte wird verurteilt, an den Kläger 21,56 € nebst Zinsen in Höhe von 5

Prozentpunkten über dem Basiszinssatz seit dem 28.9.2004 zu zahlen.

Im übrigen wird die Klage abgewiesen.

Die Kosten des Verfahrens werden vom Kläger getragen.

Das Urteil ist vorläufig vollstreckbar. Der Beklagte kann die Vollstreckung durch

den Kläger gegen Sicherheitsleistung in Höhe von 110 % des beizutreibenden

Betrages abwenden, wenn nicht der Kläger vor der Vollstreckung Sicherheit in

gleicher Höhe leistet. Der Kläger kann eine etwaige Vollstreckung durch den

Beklagten gegen Sicherheitsleistung in Höhe von 110 % des beizutreibenden

Betrages abwenden, wenn nicht der Beklagte vor der Vollstreckung Sicherheit in

gleicher Höhe leistet.
