The plaintiff brought a civil claim against the defendant. Following an oral hearing on 5 July 2004, the District Court of Düsseldorf ordered the defendant to pay €2,774.10, together with 5% interest above the base rate on specified installment amounts from dates in January through May 2003 and on €2,032.75 from 3 July 2003. The court dismissed the claim to the extent it exceeded that award and ordered the defendant to bear the costs. The judgment was provisionally enforceable for the plaintiff against security of 110% of the amount to be enforced, with security permitted by bank or savings-bank guarantee.

Die Beklagte wird verurteilt, an die Klägerin einen Betrag von 2774,10 EURO nebst 5
% Zinsen über dem Basiszinssatz auf jeweils 148,27 Euro seit dem
21.01./21.02./21.03./21.04. und 21.05.2003 sowie aus 2032,75 Euro seit dem
03.07.2003 zu zahlen. Im übrigen wird die Klage abgewiesen.
Die Beklagte trägt die Kosten des Rechtsstreits.
Das Urteil ist für die Klägerin gegen Sicherheitsleistung in Höhe von 110 % des
jeweils zu vollstreckenden Betrages vorläufig vollstreckbar. Der Klägerin wird
nachgelassen, die Sicherheit durch Bürgschaft einer Bank oder Sparkasse mit Sitz in
der Bundesrepublik Deutschland zu erbringen.
