Following an oral hearing, the Local Court Düsseldorf ordered that its default judgment dated 1 September 2003 remain in force. The plaintiff was ordered to bear the further costs of the proceedings. The judgment was declared provisionally enforceable, with the plaintiff permitted to avert enforcement by providing security of 110% of the enforceable amount unless the defendant provides security in the same amount.

Das Versäumnisurteil des AG Düsseldorf vom 01.09.2003 bleibt

aufrechterhalten.

Der Kläger trägt die weiteren Kosten des Rechtsstreits.

Das Urteil ist vorläufig vollstreckbar. Der Kläger kann die Vollstreckung

abwenden durch Sicherheitsleistung in Höhe von 110 % des aus dem

Urteil vollstreckbaren Betrags, wenn nicht die Beklagte vor der

Vollstreckung Sicherheit in gleicher Höhe leistet.
