Tenor

hat das Amtsgericht Düsseldorf auf die mündliche Verhandlung vom 03. März 2004

durch den Richter X

für R e c h t erkannt:

Die Beklagte wird verurteilt, an den Kläger 271,96 EUR nebst 5% Zinsen über

dem Basiszinssatz seit dem 21.11.2000 zu zahlen.

Im Übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits trägt der Kläger zu 87% und die Beklagte zu

13%.

Das Urteil ist vorläufig vollstreckbar. Den Parteien wird nachgelassen, die

Vollstreckung durch die jeweils andere Partei gegen Sicherheitsleistung

oder Hinterlegung eines Betrags in Höhe von 110% des jeweils zu

vollstreckenden Betrags abzuwenden, wenn nicht die jeweils andere

Partei vor der Vollstreckung Sicherheit in gleicher Höhe leistet.
