für R e c h t erkannt:

Die Beklagte wird verurteilt, an den Kläger 56,61 EUR nebst 5% Zinsen über dem

Basiszinssatz seit dem 28.2.2001 zu zahlen.

Im Übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits tragen der Kläger zu 9/10, die Beklagte zu 1/10.

Das Urteil ist vorläufig vollstreckbar.

Von der Aufnahme eines Tatbestandes wird gemäß § 313 a ZPO abgesehen.
