Tenor

hat das Amtsgericht Düsseldorf

auf die mündliche Verhandlung vom 26. November 1997

durch den Richter am Amtsgericht X

für R e c h t erkannt:

Die Klage wird abgewiesen.

Auf die Widerklage werden die Klägerin und der Drittwiderbeklagte

verurteilt, an den Erstbeklagten 5.518,84 DM nebst 4 % Zinsen aus

5.013,84 DM seit dem 26. Februar 1997 und aus weiteren 505,-- DM

seit dem 19. März 1997 zu zahlen.

Im übrigen wird die Widerklage abgewiesen.

Die Gerichtskosten und die außergerichtlichen Kosten des Erstbeklagten

werden der Klägerin und dem Drittwiderbeklagten zu 56 % als Gesamt-

schuldnern und zu weiteren 44 % der Klägerin allein auferlegt.

Die außergerichtlichen Kosten der Zweitbeklagten trägt die Klägerin.

Im übrigen tragen die Parteien ihre außergerichtlichen Kosten selbst.

Das Urteil ist für den Erstbeklagten gegen Sicherheitsleistung

von 7.900,-- DM vorläufig vollstreckbar.

Der Klägerin wird nachgelassen, die Zwangsvollstreckung der

Zweitbeklagten wegen der Kosten durch Sicherheitsleistung von

1.200,-- DM abzuwenden, wenn nicht die Zweitbeklagte vor der

Vollstreckung Sicherheit in gleicher Höhe leistet.

Die jeweils zu leistenden Sicherheiten können auch in der Form

einer selbstschuldnerischen Bürgschaft einer deutschen Großbank

oder öffentlichen Sparkasse erbracht werden.
