In this civil action, the Düsseldorf Local Court partially set aside its default judgment of 6 December 1995 and replaced it after oral proceedings. The defendant was ordered to pay DM 1,123.87 to the first plaintiffs as joint beneficiaries and DM 374.62 to the second plaintiff, each sum bearing 4% interest from 24 June 1995. The remainder of the claim was dismissed. The judgment also allocated the costs of the defendant’s default to her and apportioned the remaining court and extrajudicial costs among the defendant and plaintiffs according to the percentages set out in the order.

für R e c h t erkannt:

Das Versäumnisurteil des Amtsgerichts Düsseldorf vom 06.12.1995 wird teilweise aufgehoben und wie folgt neu gefasst:

Die Beklagte wird verurteilt, an die Kläger zu 1.) als Gesamtberechtigte 1.123,87 DM nebst 4 % Zinsen seit dem 24. Juni 1995 zu zahlen.

Die Beklagte wird verurteilt, an die Klägerin zu 2.) 374,62 DM nebst 4 % Zinsen seit dem 24.06.1995 zu zahlen.

Im übrigen wird die Klage abgewiesen.

Die Beklagte trägt die Kosten ihrer Säumnis. Die übrigen Kosten des Rechtsstreites werden wie folgt verteilt:

Die Gerichtskosten und die außergerichtlichen Kosten der Beklagten werden der Beklagten zu 71 %, den Klägern zu 1.) als Gesamtschuldnern zu 21 % und der Klägerin zu 2.) zu 8 % auferlegt. Die außergerichtlichen Kosten der Kläger zu 1.) werden der Beklagten zu 71 % und den Klägern zu 1.) zu 29 % auferlegt. Die außergerichtlichen Kosten der Klägerin zu 2.) werden der Beklagten zu 71 % und der Klägerin zu 2.) zu 29 % auferlegt.

Das Urteil ist vorläufig vollstreckbar.
