In this first-instance civil action, the District Court Bochum ordered the defendant to pay the plaintiff €31.50, but only against delivery of the original signed MiLoG declarations and exemption agreements underlying two transport orders dated 16 and 23 January 2015. Tenor

Die Beklagte wird verurteilt, an die Klägerin 31,50 EUR zu zahlen, jedoch lediglich Zug-um-Zug gegen Übersendung der im Original unterzeichneten MiLoG- Erklärungen und MiLoG-Freistellungsvereinbarungen, welche den Transportaufträgen vom 16.1.2015 (Rechnungs-Nr ###) und vom 23.01.2015 (Rechnungs-Nr. ###) zu Grunde liegen.

Die Beklagte wird verurteilt, an die Klägerin vorgerichtliche Rechtsanwaltskosten i.H.v. 169,50 EUR nebst Zinsen i.H.v. 5 Prozentpunkten über dem jeweiligen Basiszinssatz hieraus seit dem 13.7.2015 zu zahlen.

Im Übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits tragen die Klägerin zu 1/3 und die Beklagte zu 2/3.

Das Urteil ist vorläufig vollstreckbar.
