In this first-instance civil judgment, Bochum District Court ordered the defendants jointly and severally to pay the plaintiff EUR 3,631.87, with interest from 2 May 2012, and a further EUR 239.55, with interest from 22 May 2012. Tenor

Die Beklagten werden als Gesamtschuldner verurteilt, an den Kläger 3.631,87 EUR nebst Zinsen in Höhe von fünf Prozentpunkten über dem Basiszinssatz seit dem 02.05.2012 sowie weitere 239,55 EUR nebst Zinsen in Höhe von fünf Prozentpunkten über dem Basiszinssatz seit dem 22.05.2012 zu zahlen. Im Übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits trägt der Kläger zu 20%, die Beklagten zu 80%.

Das Urteil ist vorläufig vollstreckbar, für den Kläger nur gegen Sicherheitsleistung in Höhe von 120% des jeweils zu vollstreckenden Betrages. Der Kläger kann die Vollstreckung durch Sicherheitsleistung in Höhe von 110 % des auf Grund des Urteils vollstreckbaren Betrages abwenden, wenn die Beklagten nicht vor der Vollstreckung Sicherheit in Höhe von 110 % des jeweils zu vollstreckenden Betrages leisten.
