Resumo Omnilex

The District Court of Bonn granted the plaintiffs’ request to prevent the defendant from making three apartments available to third parties for periods shorter than three months, whether by rental, subletting, or other transfer. The prohibition excepts transfers to a spouse or specified relatives. The court stated that condominium co-owners may seek to stop rentals to medical tourists where concrete disturbances exist, and that a rental contrary to a local misappropriation statute constitutes a concrete impairment. The judgment threatened an enforcement fine of up to EUR 250,000 for each breach, with enforcement detention of up to six months as an alternative, and ordered the defendant to pay the costs.

WEG §§ 14 no. 1, 15(3); BGB § 1004(1) sentence 2; protection against short-term apartment rentals. Condominium co-owners may require another co-owner to refrain from renting an apartment to medical tourists where concrete disturbances impair the use of the property. A concrete impairment exists where the letting contravenes an applicable municipal statute prohibiting the misappropriation of residential accommodation. The statutory violation thus supplies a basis for the condominium-law claim for injunctive relief.
