Bonn Local Court declared invalid two resolutions adopted by the condominium owners’ meeting on 12 April 2012 under TOP 3. One changed the allocation of operating and administration costs from 2013 to distribution by co-ownership shares and spread management fees across six apartments. The other adopted the 2013 budget, including a EUR 1,000 reserve and continuation of the budget until a replacement was adopted. The defendants were ordered to bear the costs. The judgment is provisionally enforceable upon provision of security equal to the amount to be enforced plus 10%.

Tenor

  1. Die Beschlüsse der WEG-Versammlung vom 12.04.2012 unter TOP 3 , nämlich:

a.

„Es wurde unter Bezug auf § 16 Punkt 2 WEG einstimmig beschlossen, dass

sämtliche Betriebskosten sowie die Verwaltungskosten (Bankgebühren) ab dem

01.01.2013 im Verhältnis der Miteigentumsanteile abgerechnet werden sollen.

Gemeint sind die Gesamtmiteigentumsanteile unter Einbeziehung der Dachge-

schosse, die Verwaltergebühren sollen ab dem 01.01.2013 auf 6 statt bisher 4

Wohnungen verteilt werden (ebenfalls einstimmig beschlossen).“

b.

„ Es wurde sodann der Wirtschaftsplan 2013 in seiner Gesamtheit sowie in den

Einzelausfertigungen für alle Eigentümer zum 01.01.2013 mit einer Rücklage in

Höhe von 1.000,00 ansonsten mit unveränderten Beträgen (außer Verwaltergebüh-

ren) beschlossen“; „Der Wirtschaftsplan 2013 läuft fort, bis ein neuer Wirtschaftsplan

beschlossen wird,

werden für ungültig erklärt.

Die Beklagten tragen die Kosten des Rechtsstreits.

Das Urteil ist gegen Sicherheitsleistung in Höhe des beizutreibenden Betrages zuzüglich 10 % vorläufig vollstreckbar.
