Tenor
Die Klage wird abgewiesen.
Auf die Widerklage hin, wird der Kläger verurteilt, an die Beklagten 5.523,74 EUR zu zahlen nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem 06.04.2007.
Der Kläger wird verurteilt, das Kautionssparbuch Nr. ###### bei der T C an die Beklagten heraus und die Verwendung frei zu geben.
Die Kosten des Rechtsstreits tragen der Kläger zu 3/4, die Beklagten als Gesamtschuldner zu 1/4.
Die Kosten der Verweisung trägt der Kläger.
Das Urteil ist vorläufig vollstreckbar gegen Sicherheitsleistung in Höhe von 110 % des beizutreibenden Betrages.
