Tenor

Die Beklagte wird verurteilt, an den Kläger 2638,50 Euro zuzüglich 5 % Zinsen über dem Basiszinssatz seit dem 06.05.2002 Zug um Zug gegen Rückübereignung und Rückgabe des Pkw's Peugeot 405 Kombi Diesel, Fahrgestellnummer ###### zu zahlen:

Es wird festgestellt, dass der Beklagte sich mit der Rücknahme des Pkw's in Annahmeverzug befindet.

Die Kosten des Rechtsstreits fallen der Beklagten zur Last.

Das Urteil ist vorläufig in Höhe einer Sicherheitsleistung von 110 % des beizutreibenden Betrag vollstreckbar.
