The Bonn Local Court declined to remedy the appeal against its 12 October 2001 search warrant and transmitted the file to the Bonn Regional Court’s criminal chamber. Separately, on the Federal Cartel Office’s application, it ordered seizure under §§ 94 and 98 StPO of documents secured in the search on 24 October 2001, as itemized in an annex. The order excluded materials designated for return and correspondence sent by or addressed to a lawyer.

Tenor

wird der Beschwerde gegen den Durchsuchungsbeschluß des Amtsgerichts Bonn vom 12.10.2001 - 50 Gs 948/01 - nicht abgeholfen. Die Akten werden der Beschwerdestrafkammer des Landgerichts Bonn zur Entscheidung über diese Beschwerde vorgelegt.

Ferner wird gem. §§ 94, 98 StPO auf Antrag des Bundeskartellamtes die

Beschlagnahme

der anläßlich der Durchsuchung vom 24.10.2001 sichergestellten Unterlagen entsprechend der Anlage zu diesem Beschluß mit Ausnahme der Unterlagen,

in denen es in der Anlage jeweils heißt "wird zurückgesandt" sowie mit Ausnahme des Schriftverkehrs, der von einem Anwalt stammt oder an einen Anwalt gerichtet ist, angeordnet.
