Resumo Omnilex

The plaintiff sued to challenge her expulsion from the defendant lawyers' association after falling behind on two death-benefit fund levies. The Bonn District Court held that association expulsions are generally open to judicial review and that internal remedies need not be exhausted where this would be unreasonable. That exception applied because the defendant was the only lawyers' association of its kind in the city. The court nevertheless upheld the association's rule allowing expulsion for arrears on two levies. It also rejected the equality challenge to different death-benefit treatment for members joining before and after age 50, finding that it reflected differing membership durations. The action was dismissed, with costs against the plaintiff.

BGB § 315(3), second sentence; judicial review of an association expulsion and exhaustion of internal remedies. An association resolution expelling a member is in principle subject to judicial review. A member may exceptionally approach the ordinary courts without first exhausting internal remedies where doing so would be unreasonable in the circumstances. This applies in particular where the association has a monopolistic position or membership is of special professional, economic, or social importance; membership in the sole lawyers' association of its kind in a city meets that criterion. A rule permitting expulsion for arrears on two death-benefit fund levies is not contrary to higher-ranking law. Different death-benefit treatment tied to entry before or after age 50 is not, on the stated facts, unequal treatment, since it reflects differing periods of membership in the association.

Tenor

An expulsion decision is generally subject to judicial review, and exhaustion of internal remedies was not required in this case.

Internal remedies need not be exhausted when doing so would be unreasonable in the circumstances, including where membership in an association with a monopolistic position or particular professional, economic, or social importance is at stake. The defendant was the only lawyers' association of its kind in the city.

The rule was permissible and did not violate higher-ranking law; the distinction in death benefits did not amount to impermissible unequal treatment.

The difference in benefits reflected the different lengths of time for which the lawyers had been organized in the association.

The claim was dismissed.

The association's expulsion rule was valid, and the court found no basis to grant the plaintiff's claim.
