The plaintiffs sued their neighbors over a walnut tree whose branches extended onto the plaintiffs’ property. The Kerpen Local Court ordered the defendants to prune the tree so that no branches or twigs crossed the property line and to pay €229.55 in pre-litigation legal fees. It dismissed the remainder of the claim and allocated the costs of the proceedings to the defendants. The court held that municipal tree-protection bylaws enacted in North Rhine-Westphalia do not constitute state-law provisions under Article 111 EGBGB.
Art. 111 EGBGB; meaning of “state-law provisions”: The term refers to rules applicable throughout an entire federal state. Municipal tree-protection bylaws adopted in North Rhine-Westphalia apply only within the enacting municipality and therefore do not fall within Art. 111 EGBGB. The contrary view expressed by OLG Hamm (order of 6 November 2007, 3 Ss OWi 494/07, NJW 2008, 453) is not followed.

Unter "landesgesetzlichen Vorschriften" im Sinne von Art. 111 EGBGB können nur solche Regelungen verstanden werden, welche in einem gesamten Bundesland anzuwenden sind. In NRW erlassene kommunale Baumschutzsatzungen fallen nicht unter die Vorschrift (a.A. OLG Hamm Beschluss vom 6.11.2007 - 3 Ss OWi 494/07-, NJW 2008, 453).
Die Beklagten werden als Gesamtschuldner verurteilt,
den auf dem Grundstück des Grundeigentums F-straße ... in 50170 K. in Höhe des Hauses der Kläger stehenden Walnussbaum so zurückzuschneiden, dass keine Äste und Zweige auf das Grundstück der Kläger F-straße ... in 50170 K. hinüber ragen und
an die Kläger vorgerichtliche Anwaltskosten in Höhe von 229,55 € zu zahlen.
Im übrigen wird die Klage abgewiesen.
Die Kosten des Rechtsstreits werden den Beklagten auferlegt.
Das Urteil ist für die Kläger gegen Sicherheitsleistung in Höhe von 5000 € vorläufig vollstreckbar.
