Resumo Omnilex

The plaintiff brought proceedings concerning the defendant's threatened interruption of water supply as leverage to collect unpaid electricity bills. The parties jointly declared part of the dispute settled. The Kerpen Local Court dismissed the claim insofar as it remained pending and ordered the defendant to pay the costs. It held that a water disconnection under the AVBWasserV, including by reliance on § 273 BGB, requires an unmet obligation specific to water supply. A supplier acts contrary to public policy if it threatens removal of the water meter to compel payment of debts arising from another supply service. The court granted leave to appeal because the case was of fundamental importance.

Sumário Omnilex

§ 33 Abs. 2 Satz 1 AVBWasserV; § 273 BGB; requirements for discontinuing water supply to enforce a claim from another supply category. The right to withhold performance under § 273 BGB may be exercised only where its conditions are met in addition to those specified by the AVBWasserV. The regulation presupposes that the customer has failed adequately to perform an obligation relating to the particular supply service at issue. A supplier therefore cannot interrupt water service to enforce payment obligations arising from electricity supply. Threatening removal of the water meter as pressure to collect such debts is contrary to public policy.

Dokumenttyp: Urteil

Spruchkörper: Abteilung 22

Normen: AVBWasserV § 32 Abs. 2 Satz 1; BGB § 273

Leitsätze

(vgl. ebenso AG Lübeck, Urteil vom 6.11.2006, 22 C 2737/06, WuM 2007, 391 ff.

A water disconnection requires both the statutory conditions and a sufficiently unmet obligation specific to water supply; electricity debts do not justify using a threatened meter removal to pressure the customer.

The customer must have failed to perform an obligation relating to the water supply. Using the threat of removing the water meter to compel payment of debts from another supply category is contrary to public policy.

The defendant must bear the costs.
