Tenor
Die Beklagte wird verurteilt, es zu unterlassen, im geschäftlichen Verkehr ohne ausdrückliches Einverständnis per E-Mail Werbung an die Klägerin zu versenden, wobei für den Fall der Zuwiderhandlung ein Ordnungsgeld bis 250.000,00 Euro und für den Fall, dass dieses nicht beigetrieben werden kann, Ordnungshaft bis zu 2 Jahren angedroht wird.
Die Beklagte wird ferner verurteilt, an die Klägerin 265,70 Euro zuzüglich Zinsen in Höhe von 8 Prozentpunkten über dem jeweiligen Basiszinssatz seit dem 28.11.2008 zu zahlen.
Die Beklagte trägt die Kosten des Rechtsstreits.
Das Urteil ist vorläufig vollstreckbar.
Die Beklagte kann die Zwangsvollstreckung der Klägerin gegen Sicherheitsleistung in Höhe von 110 % des jeweils zu vollstreckenden Betrages abwenden, wenn nicht die Klägerin vor der Vollstreckung Sicherheit in gleicher Höhe leistet.
