Resumo Omnilex

The Eschweiler Local Court dismissed the plaintiff's claim arising from a collision between a left-turning driver intending to enter private property and an oncoming straight-ahead driver. The latter had exceeded the speed limit by at least 130%; under the stated circumstances, that speed alone entailed a liability share of at least 30% for the straight-ahead driver despite the left-turner's general duty to yield. The left-turner's alleged intoxication did not reduce the oncoming driver's responsibility, since the court could not assume that a sober left-turner would have assessed the oncoming vehicle's speed correctly and avoided the collision. The plaintiff was ordered to bear the proceedings' costs, and the judgment was declared provisionally enforceable.

Sumário Omnilex

In a collision between a left-turning driver subject to a duty to yield and an oncoming straight-ahead driver, exceeding the applicable maximum speed by at least 130% justifies a liability share of at least 30% for the straight-ahead driver. The left-turner's intoxication does not, by itself, reduce that share in favor of the straight-ahead driver. Such a reduction cannot rest on the assumption that a sober left-turner would have correctly estimated the oncoming vehicle's speed and avoided the collision.

The claim was dismissed; the oncoming driver's excessive speed would entail at least 30% liability, but the left-turner's intoxication did not increase the straight-ahead driver's share.

The oncoming vehicle's speed exceeded the permitted maximum by at least 130%. The left-turner's alcohol consumption did not benefit the oncoming driver, because it could not be assumed that a sober driver would have correctly estimated the oncoming vehicle's speed and avoided the collision.

The plaintiff bears the costs of the proceedings.

The judgment dismissed the plaintiff's claim and expressly allocated the costs to the plaintiff.

The judgment is provisionally enforceable; the plaintiff may avert enforcement by providing security of 120% of the amount being enforced, unless the defendants provide security in the same amount.
