In a judgment dated 8 July 2009, the Aachen Local Court considered a challenge to an owners’ assembly resolution concerning the further course of action regarding a co-owner’s isolated co-ownership share. Tenor

I.

Der Beschluss der Eigentümerversammlung vom 22.01.2009 unter Tagesordnungspunkt 2 (Weitere Vorgehensweise der Eigentümergemeinschaft in Bezug auf den isolierten Miteigentumsanteil des Miteigentümers I) wird für ungültig erklärt.

II.

Die Kosten des Rechtsstreites tragen die Beklagten.

III.

Dieses Urteil ist in seiner Kostenentscheidung vorläufig vollstreckbar, aber nur gegen Sicherheitsleistung in Höhe von 110 % des jeweils zu vollstreckenden Betrages.
