The Local Court of Aachen ordered the defendants jointly and severally to pay the plaintiff EUR 684.88, together with interest at five percentage points above the base rate from 25 April 2006. The court dismissed the claim to the extent it exceeded that award. The defendants were assigned 82% of the litigation costs and the plaintiff 18%. The judgment was declared provisionally enforceable, subject to security provisions allowing the defendants to avert enforcement by providing security of 110% of the amount being enforced, unless the plaintiff first provides equivalent security.

Tenor

Die Beklagten werden als Gesamtschuldner verurteilt, an den Kläger 684,88 Euro nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem 25.4.2006 zu zahlen.

Die weitergehende Klage wird abgewiesen.

Von den Kosten des Rechtsstreites tragen die Beklagten 82 % und der Kläger 18 %.

Das Urteil ist vorläufig vollstreckbar. Die Beklagten dürfen die Vollstreckung gegen

Sicherheitsleistung in Höhe von 110 % des zur Vollstreckung kommenden Betrages abwenden, wenn nicht der Kläger vor der Vollstreckung Sicherheit in gleicher Höhe leistet.
