Aachen Local Court authorized its provisional insolvency administrator to take possession of a laptop held by limited partner M, with a suitable expert, to secure data relevant to the insolvency proceedings. Tenor

Der vom Gericht bestellte vorläufige Verwalter wird ermächtigt, den im Besitz des Kommanditisten M, befindlichen Laptop unter Hinzuziehung eines geeigneten Sachverständigen zur Sicherung der dieses Insolvenzverfahren betreffenden Daten in Besitz zu nehmen.

Der Gerichtsvollzieher wird ermächtigt, zu diesem Zwecke verschlossene Haustüren, Zimmertüren und Behältnisse öffnen zu lassen. Findet er Widerstand, so ist er zur Anwendung von Gewalt befugt und kann zu diesem Zweck um die Unterstützung der polizeilichen Vollzugsorgane nachsuchen.

Soweit der vorgefundenen Laptop für die Aufklärung der schuldnerischen Vermögensverhältnisse von Bedeutung sein kann, ist er zu beschlagnahmen. Der Gerichtsvollzieher hat ihn sicherzustellen und dem vorläufigen Verwalter zu übergeben.

Der Beschluss darf der Schuldnerin frühestens bei Beginn der Vollziehung bekanntgemacht werden. Die Vollziehung ist schon vor der Bekanntmachung des Beschlusses zulässig.
