Tenor

Der Beklagte wird verurteilt, an die Klägerin 7 € nebst Zinsen in Höhe von 5 Pro-zentpunkten über dem Basiszinssatz seit dem 23.03.2006 zu zahlen; im übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits tragen die Klägerin zu 85% und der Beklagte zu 15%.

Das Urteil ist vorläufig vollstreckbar.
