Tenor

Die Beklagte wird verurteilt, an den Kläger 67,28 € nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem 12.01.2006 sowie 22,62 € außergerichtliche Anwaltskosten zu zahlen.

Im übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits tragen der Kläger zu 80 € und die Beklagte zu 20 %.
