Resumo Omnilex

The complainant challenged letters sent by the Social Welfare Office of the T. District Office to various authorities seeking information about her workplace and residence. She alleged the requests were intended to establish non-existent maintenance claims by her brother and violated her right to human dignity. The Constitutional Court of the State of Berlin dismissed the constitutional complaint as inadmissible because she had not first exhausted the remedies available before the specialist courts. The court found no indication that the statutory exception allowing waiver of exhaustion applied. It also noted that the decision was unappealable.

Sumário Omnilex

§ 49(2) VGHG BE; exhaustion of legal remedies before constitutional complaint. The fact that constitutional questions may be relevant to a dispute does not relieve a complainant of the obligation to exhaust the remedies available before the specialist courts before applying to the Constitutional Court. The constitutional guarantee of access to legal recourse against alleged violations of rights by public authority is reflected in Art. 19(4), sentences 1 and 2, GG. Waiver of exhaustion is available only where the statutory exception is satisfied; absent facts indicating that its conditions may be met, the complaint is inadmissible.

Orientierungssatz

The complaint was inadmissible because the complainant had not exhausted the available legal remedies, and no exception permitting waiver of that requirement was apparent.

The possibility that constitutional questions may arise does not dispense with the requirement to exhaust the specialist-court route before applying to the Constitutional Court. No facts indicated that the statutory exception applied.
