The Zurich cantonal prosecution had appealed a district court judgment in a criminal threat case, but then withdrew the appeal before the Obergericht. The appellate chamber therefore struck the case off as concluded by withdrawal and held that the first-instance judgment of 23 March 2016 became final. It also ordered the costs of the appellate proceedings to be borne by the court treasury. The order further directed written notification to the accused persons, the prosecution, and, after expiry of the appeal period, to the first-instance court.
Withdrawal of appeal; discontinuance of appellate proceedings and costs: if the appellant withdraws the appeal before the appellate court rules on the merits, the appeal proceedings are to be struck off as terminated; the challenged judgment becomes final. In the absence of a merits decision, the court allocates the costs of the appeal proceedings ex officio, here to the court treasury (consid. 1-2).

Erwägungen: Am 31. März 2016 meldete die Staatsanwaltschaft Zürich-Sihl gegen das Urteil des Bezirksgerichts Zürich, Einzelgericht, vom 23. März 2016 (Urk. 30) Berufung an (Urk. 32). Mit Eingabe vom 21. Juni 2016, hierorts eingegangen am 22. Juni 2016, hat die Staatsanwaltschaft Züri ch-Sihl die Berufung zurückgezogen (Urk. 39). Das Ver- fahren ist demgemäss als durch Rückzug der Berufung erledigt abzuschreiben unter ausgangsgemässer Regelung der Kostenfolgen. Es wird verfügt: (Oberrichter Dr. iur. F. Bollinger) 1. Das Verfahren wird als durch Rückzug der Berufung erledigt abgeschrieben. Demzufolge ist das Urteil des Bezirksgerichtes Zürich, 10. Abteilung, vom 23. März 2016 rechtskräftig. 2. Die Kosten des Berufungsverfahrens werden auf die Gerichtskasse ge- nommen. 3. Schriftliche Mitteilung an − die Beschuldigte A._____ − den Beschuldigten B._____ − die Staatsanwaltschaft Zürich-Si hl sowie nach unbenütztem Ablauf der Rechtsmittelfrist resp. Erledigung allfälliger Rechtsmittel an die Vorinstanz (unter Rücksendung der Akten). 4. Rechtsmittel: Gegen diesen Entscheid kann bundesrechtli che Beschwerde in Straf- sachen erhoben werden. Die Beschwerde ist innert 30 Tagen, von der Zustellung der vollständigen, begründeten Ausfertigung an gerechnet, bei der Strafrechtlichen Abteilung
des Bundesgerichtes (1000 Lausanne 14) in der in Art. 42 des Bundes- gerichtsgesetzes vorgeschriebenen Weise schriftlich einzureichen. Die Beschwerdelegitimation und die weiteren Beschwerdevoraussetzungen richten sich nach den massgeblichen Bestimmungen des Bundesgerichts- gesetzes.
