The claimant challenged an order of the justice of the peace that treated her post-hearing statement as a provisional withdrawal and discontinued the proceedings. Art.208 Abs. 2 ZPO, Art. 59 Abs. 2 lit. e ZPO. Rückzug der Klage unter Vor- behalt im Schlichtungsverfahren. Im Schlichtungsverfahren kann das Begehren "unter Vorbehalt" ohne Sperrwirkung zurückgezogen werden; zurückgezogen ist diesfalls nur das Schlichtungsbegehren, nicht die Klage selber.

Die Klägerin ficht die Verfügung des Friedensrichters an, welcher erwägt, die Klägerin habe die Klage im Anschluss an die Verhandlung "einstweilen zurückgezogen", und das Verfahren gestützt darauf abschreibt. Sie habe nachträglich Unterlagen gefunden, welche den Standpunkt der Gegenpartei widerlegten.

(Erwägungen des Obergerichts:)

  1. (...) Zur Geltendmachung der Unwirksamkeit eines Vergleichs, eines Kla- gerückzugs oder einer Klageanerkennung ist die Revision zu erheben (Art. 328 Abs. 1 lit. c ZPO). Entsprechend ist ein Willensmangel im Zusammenhang mit dem Klagerückzug nicht mit Berufung oder Beschwerde, sondern mit der Revision nach Art. 328 ff. ZPO geltend zu machen (vgl. Disp. Ziff. 5 der Verfügung des Friedensrichters). Für die Revision ist das Gericht zuständig, welches als letzte Instanz in der Sache entschieden hat (Art. 328 Abs. 1 ZPO). Dies im Unterschied zur Berufung und zur Beschwerde, welche beim Obergericht zu erheben sind (Art. 311 Abs. 1 ZPO, Art. 321 Abs. 1 ZPO, § 48 GOG). Vorliegend ist somit das Friedensrichteramt Bülach und nicht das Obergericht des Kantons Zürich zustän- dig zur Beurteilung der Revision. Entsprechend fehlt es dem Obergericht an der sachlichen Zuständigkeit zur Überprüfung der klägerischen Vorbringen, weshalb auf das Begehren nicht einzutreten ist. Der Vollständigkeit halber bleibt anzumerken, dass die Klägerin ihre Klage lediglich "einstweilen" zurückgezogen hat. Es liegt somit kein vorbehaltloser Kla- gerückzug vor, sondern bloss ein Rückzug des Schlichtungsgesuches (vgl. Art. 208 ZPO; U. EGLI, Dike-Komm-ZPO, Art. 208 N 4). Aus diesem Grund steht es der Klägerin frei, erneut Klage gegen den Beklagten anzuheben.
