The Zurich Higher Court dealt with costs in an appeal that was partly not entered into and partly dismissed as moot. It held that the plaintiffs had caused both the appeal proceedings and the mootness, so they had to bear the full appellate costs. The court fixed the fee at CHF 2,000 and ordered it to be taken from the CHF 5,000 advance. The remaining CHF 3,000 was to be refunded to the plaintiffs, not to their lawyer, because a third-party payment of the advance is treated as payment by the party; any internal reimbursement dispute is a matter between lawyer and client.

Art. 98, 106, 107 and 111 CPC; Art. 68 OR; third-party payment of a procedural cost advance: if a cost advance is paid by a third party on behalf of a party, the payment is attributed to that party for the purposes of the court proceedings. The court must therefore refund any surplus of the advance to the party and not to the third-party payer. Any claim between the party and the third-party payer is governed exclusively by their internal relationship. As to costs after mootness, the court may allocate them in equity under Art. 107(1)(e) CPC; a costs decision must not anticipate the merits by way of a quasi-substantive assessment (consid. 4).

Art. 98 ZPO, Vorschuss für Prozesskosten. Art. 111 ZPO, Liquidation der Prozesskosten. Behandlung des von einem Dritten bezahlten Vorschusses. Zahlt ein Dritter den Vorschuss, leistet er für die Partei. Ein Überschuss wird da- her der Partei zurück erstattet und die Auseinandersetzung Partei/Dritter ist eine Sache deren Innenverhältnisses.

Einer Partei ist ein Kostenvorschuss auferlegt worden. Ein Dritter leistete den Betrag und ersuchte gleichzeitig darum, dass ein allfällige Rückzahlung an i hn erfolge. Das Obergericht kommt dem nicht nach.

(aus den Erwägungen des Obergerichts:)

  1. Prozesskosten Soweit auf die Berufung nicht eingetreten wird, unterliegen die Klägerinnen, weshalb sie insofern zur Tragung der Prozesskosten zu verpflichten sind (Art. 106 Abs. 1 ZPO). Soweit das Verfahren als gegenstandslos abgeschrieben wird, er- folgt die Verteilung nach Ermessen (Art. 107 Abs. 1 lit. e ZPO). Da nicht auf dem Weg über den Kostenentscheid quasi ein materielles Urteil gefällt werden soll, muss die Frage, ob die Klägerinnen mit ihrem Begehren auf Ungültigerklärung der Kündigungen bzw. dem Erstreckungsbegehren durchgedrungen wären, offen bleiben (OGerZH, I. ZK, 28. Juni 2012, RV120002; BGer 2C_237/2009). Es ist deshalb darauf abzustellen, dass die Klägeri nnen das Berufungsverfa hre n veran- lasst und die Gegenstandslosigkeit verursacht haben. Die Prozesskosten des Be- rufungsverfahrens sind ihnen deshalb insgesamt aufzuerlegen. Die Entscheidge- bühr ist unter Berücksichtigung des reduzierten Aufwandes auf CHF 2'000.00 festzusetzen und aus dem geleisteten Vorschuss von CHF 5'000.00 zu beziehen. Eine Rückzahlung des Differenzbetrages von CHF 3'000.00 erfolgt durch die Obergerichtskasse, sofern keine verrechenbaren Forderungen gegen die Kläge- rinnen aus anderen Verfahren bestehen. Eine allfällige Rückzahlung erfolgt an die Klägerinnen selbst und nicht an Rechtsanwalt A. , wie der dies in der Eingabe vom 4. Februar 2015 verlangt hat. Denn dessen Intervention im Sinne von Art. 68 OR hat zur Folge, dass der vom Anwalt geleistete Kostenvorschuss als von den Klä- gerinnen geleistet gilt. Im Verhältnis zwischen den Prozessparteien und dem Ge- richt spielt es also keine Rolle, wer den Kostenvorschuss geleistet hat (OGerZH

  2. Mai 2014, LF140026). Daran vermag der Umstand nichts zu ändern, dass die Zahlung durch den Anwalt möglicherweise zu einer Zahlungspflicht der Klientin- nen an den Anwalt führt.
