The applicable procedure is determined by the objective character of the claim and not by the personal identity of the litigants. Consequently, cession and other changes of parties do not alter the procedural rules where the underlying dispute remains a consumer dispute. This applies a fortiori where the consumer remains the same and only the provider side has changed (consid. cited in the order).

ZPO 53, einfaches und rasches Verfahren. Das Verfahren hängt vom Charakter der Forderung ab und nicht von den Parteien; daher ändern Abtretung und andere Wechsel der Personen an den prozessualen Regeln nichts. Erwägungen: "Der Streit der Parteien geht um Reparaturarbeiten eines Garagisten an Autos seines Kunden. Das sind Leistungen eines Anbieters für einen Konsumen- ten im Sinne der Verordung SR 944.8 über die Streitwertgrenzen im Konsumen- tenverfahren resp. im Sinne von § 53 Abs. 2 ZPO. (...) Im Prozess klagt nun nicht der ursprüngliche Leistungserbringer, sondern sein Zessionar. Im parallelen Fall des Arbeitsrechts gehen Literatur und Praxis davon aus, dass (entgegen der Formulierung von § 13 GVG/ZH) das Verfahren vom Charakter der Forderung abhängt und nicht von den Parteien, sodass insbe- sondere Abtretung und andere Wechsel der Personen an den prozessualen Re- geln nichts ändern (Berner Kommentar Rehbinder, N. 2 zu Art. 343 OR; Streiff/ von Kaenel, Arbeitsvertrag, 5. Aufl. 1993, N. 5 zu Art. 343 OR [mit Hinweisen auf die Gegenargumente]). Die Lösung lässt sich auf den Konsumentenstreit ohne weiteres übertragen.
