The Obergericht addressed the practical problem that a party can delay proceedings by activating a postal hold order for court mail. A cost-advance order sent as registered court mail was returned by the post without an avviso, then resent successfully after the hold period ended. The court observed that postal practice had changed and could frustrate service, but held that in this case, because the hold period was still short and substitute service measures were only being prepared, no alternative service was yet required.
Art. 138 Abs. 3 lit. a ZPO; service fiction and registered court mail returned because of a postal hold order: A party must not be able to frustrate judicial service by means of a hold order with the post. Where a registered court mailing cannot be delivered and no delivery notice is left because of such an order, the practical consequences may differ from ordinary failed delivery. Whether alternative service must immediately be attempted depends on the concrete circumstances, in particular the remaining duration of the hold order and the procedural stage of the court’s preparations (consid. 2).

auftrages, und da die nötigen Vorbereitungen erst in Arbeit waren, auf eine alter- native Zustellung (noch) verzichtet wurde. Namentlich bei länger dauernden Rückhalteaufträgen wird die Unmöglichkeit der Zustellung durch die Post aber nicht weiter so hingenommen werden können.
