Resumo Omnilex

The decision clarifies that, even after entry into force of the Water Management Act, municipalities remain competent to assess compliance with municipal water setback lines and the former cantonal minimum water setback. If a project violates both, the municipality must decide first whether a reduction of the municipal setback is permissible; only if it grants the dispensation, or if no municipal setback line exists, does cantonal review become necessary. Municipal water setback lines are not equivalent to building lines for river corrections or shore paths and may be overridden only under the special exception rules of the PBG.

Sumário Omnilex

§ 21 WWG, § 67 PBG, § 96 PBG, §§ 220, 357 PBG; competence regarding water setback lines and distinction from building lines: Municipal authorities remain competent to assess observance of municipal water setback lines and the former cantonal minimum water setback. Where municipal setback lines exist, the municipality must first decide on any dispensation from the municipal setback requirement; cantonal intervention is required only if such dispensation is granted or if no municipal setback line is in force. Municipal water setback lines are planning instruments increasing the minimum setback and are not governed by the legal regime of building lines under § 96 PBG. Authorization of a breach is possible only under the special exception provisions of the PBG (consid. 4.c, 5.a).

BRKE I Nr. 396/1994 vom 9.

Which authority is competent to assess compliance with the former cantonal water setback and municipal water setback lines under the WWG and PBG?

Decisão extraída

Municipalities remain competent to assess whether the former cantonal 5 m water setback and municipal setback lines are respected; dispensations from municipal setback lines also fall within municipal competence, while exceptions to the cantonal minimum setback are decided by the Baudirektion.

Fundamentação extraída

Under the WWG, the municipal competence to decide on local setback lines continues; only the cantonal minimum setback and exceptions to it are reserved to the cantonal building authority.

Questão jurídica principal

If a project violates both municipal and cantonal water setback requirements, must the canton be called upon before the municipality refuses the permit?

Decisão extraída

No. The municipality must decide first on the municipal setback line; if it refuses the dispensation, the project need not be submitted to the cantonal authority.

Fundamentação extraída

Cantonal review is only necessary if the municipality grants the dispensation for the municipal setback line or if no municipal setback line exists at all.

Questão jurídica principal

Are municipal water setback lines to be treated like building lines for river corrections and shore paths?

Decisão extraída

No. Municipal water setback lines under § 67 PBG are distinct from building lines under § 96 PBG and serve a planning function to raise the minimum water setback.

Fundamentação extraída

Their purpose is not merely to secure existing or planned installations, but to define the distance between structures and public waters for spatial-planning purposes.

Questão jurídica principal

Under what rules may a violation of municipal water setback lines be authorized?

Decisão extraída

A permit may be granted only if the conditions for an exception under § 220 PBG or § 357 PBG are met.

Fundamentação extraída

Because setback lines are not governed by the rules applicable to building lines, their breach requires a special legal basis for authorization.
