In the Council of States, an order motion was made in connection with the debate on the disputed Article 51 of the Railway Act. Ulrich Gadient argued for postponing the discussion until 15:00, while Carlo Schmid asked to begin immediately. Kaspar Rhyner supported postponement. The chamber voted 16 to 9 in favor of Gadient's motion.
Parliamentary procedure; order motions concerning the conduct of debate are decided by majority vote. Where two procedural requests are opposed, the motion obtaining the majority prevails and the competing request is rejected. Considerations of coherence of the discussion and the presence of members may be relevant to the chamber's procedural discretion.

Präsident: Die Behandlung des Eisenbahngesetzes mit dem umstrittenen Artikel 51 ist für den Nachmittag geplant Haben Sie den Wunsch, die beiden Referate der Vertreter von Kom- missionsmehrheit und -minderheit jetzt noch anzuhören?
Gadient Ulrich (V, GR): Ich habe etwelche Bedenken, wenn man die Erörterung dieses kohärenten Sachverhaltes jetzt auseinanderreissen würde; es ist auch fraglich, ob Herr Ogi jetzt noch verfügbar wäre. Er müsste aber auf alle Fälle zuge- gen sein. Ich sehe ferner, dass einige Ratsmitglieder abwe- send sind. Da es um eine Weichenstellung geht, wäre ich der Meinung, die Diskussion erst um 15 Uhr aufzunehmen.
Schmid Carlo (C, Al): Ich wage den Verdacht zu äussern, dass diese beiden Referate an der Kohärenz der Vorlage nicht viel ändern würden. Ich stelle den Antrag, mit der Debatte zu be- ginnen.
Rhyner Kaspar (R, GL): Ich möchte doch den Antrag unter- stützen, jetzt noch nicht über dieses Geschäft zu debattieren. Viele Plätze im Saal sind nicht besetzt, und die Argumente für oder gegen den umstrittenen Artikel - das meine ich in Gegen- satz zu Kollega Schmid - sind doch so wichtig, dass man sie anhören müsste.
