The National Council, after hearing the report of the Commission for Petitions and Examination of Cantonal Constitutions, approved the federal decree guaranteeing the revised constitutions of Lucerne, Solothurn, Appenzell Ausserrhoden, Aargau and Valais. The chamber followed the Federal Council’s view that the amendments lay within cantonal organizational autonomy and did not conflict with the Federal Constitution or other federal law. The vote on the whole was unanimous, and the matter was sent to the Council of States.
Cantonal constitutions; federal guarantee. Amendments to cantonal constitutions must be guaranteed if they remain within cantonal constitutional autonomy and are not contrary to the Federal Constitution or other federal law. Parliamentary review is limited to this conformity check; where no federal inconsistency appears, the guarantee is granted (consid. not specified).

Frau Jeanprêtre unterbreitet im Namen der Kommission den folgenden schriftlichen Bericht:
Die Petitions- und Gewährleistungskommission des National- rates hat die Botschaft des Bundesrates über die Gewährlei- stung der geänderten Verfassungen der Kantone Zürich, Lu- zern, Freiburg, Schaffhausen, Graubünden, Waadt und Wallis am 28. August 1991 geprüft.
Die Kommission ist mit dem Bundesrat der Meinung, dass sich die Aenderungen dieser Kantonsverfassungen im Rah- men der kantonalen Verfassungsautonomie bewegen und we- der die Bundesverfassung noch das übrige Bundesrecht ver- letzen.
Mme Jeanprêtre présente au nom de la commission le rap- port écrit suivant:
La Commission des pétitions et de l'examen des constitutions cantonales du Conseil national a examiné le message du Conseil fédéral concernant la garantie des constitutions révi- sées des cantons de Zurich, Lucerne, Fribourg, Schaffhouse, Grisons, Vaud et Valais le 28 août 1991.
La commission estime comme le Conseil fédéral que les modi- fications de ces constitutions cantonales relèvent de la com- pétence des cantons en matière d'organisation. Elles ne sont contraires ni aux dispositions de la Constitution fédérale, ni à d'autres dispositions du droit fédéral.
Antrag der Kommission Die Kommission beantragt, alle diese Verfassungsänderun gen zu gewährleisten.
Proposition de la commission La commission propose d'accorder la garantie à toutes ces modifications constitutionnelles.
