The European Commission of Human Rights dealt with Schenk’s complaint that his conviction violated the presumption of innocence because it rested on an allegedly unlawful recording. The Commission held that Article 6 § 2 ECHR guarantees the presumption of innocence until guilt is legally established, but does not govern whether guilt is proven in a fair trial. That question belongs to Article 6 § 1. The complaint based on Article 6 § 2 was therefore rejected.

Art. 6 § 2 ECHR; presumption of innocence and lawful establishment of guilt. The guarantee that an accused is presumed innocent until guilt has been legally established concerns the status of the accused before conviction. Whether guilt is established in proceedings conducted in accordance with law is a question of the fairness of the trial under Art. 6 § 1, not of the presumption of innocence under Art. 6 § 2 (consid. 1). A complaint that evidence was unlawfully obtained does not, by itself, transform into an Art. 6 § 2 issue; it must be assessed, if at all, under the rules governing fair trial.

Art. 6 § 2 CEDH. Présomption d'innocence.

Cette disposition garantit à un accusé le droit d'être présumé innocent «jusqu'à ce que» sa culpabilité ait été légalement établie. Que la culpabilité soit établie à l'issue d'un procès conformément à la loi relève de la notion de «procès équitable» vise à l'art. 6 § 1, et non de son § 2.

Art. 6 § 2 EMRK. Unschuldsvermutung.

Gestützt auf diese Bestimmung wird die Unschuld eines Angeklagten «bis» zum gesetzlichen Nachweis seiner Schuld vermutet. Für den Nachweis der Schuld im Strafprozess gemäss Gesetz gelten die Regeln des fairen Verfahrens von Art. 6 § 1 und nicht diejenigen von § 2.

Questa disposizione garantisce a un accusato il diritto d'essere presunto innocente fino a che la sua colpevolezza non sia stata legalmente stabilita. Il fatto che la colpevolezza sia stata stabilita alla conclusione di un processo conforme alla legge è attinente alla nozione di processo equo, di cui al § 1 e non al § 2.

En ce qui concerne l'art. 6 § 2, la Commission constate que le requérant s'est plaint que le principe de la présomption d'innocence ait été méconnu au motif que sa culpabilité n'aurait pas été établie «légalement» en raison de l'utilisation d'un enregistrement illégal. Or, cette référence à l'art. 6 § 2 résulte d'une interprétation erronée de cette disposition. Cette disposition garantit à un accusé le droit d'être présumé innocent «jusqu'à ce que» sa culpabilité ait été légalement établie. Or, que la culpabilité soit établie à l'issue d'un procès conformément à la loi relève à la vérité de la notion de procès équitable» visé à l'art. 6 § 1.
