Resumo

The President of the Tribunal d'accusation dealt with an appeal by the complainant against a no-prosecution order issued in a criminal investigation for breach of maintenance obligations. Before the merits were examined, the complainant withdrew the appeal by letter of 29 June 2009. The court therefore took formal notice of the withdrawal, ended the appellate proceedings, and rendered the decision without costs.

Withdrawal of an appeal; once the appellant expressly withdraws the remedy, the appellate court takes formal notice of the withdrawal and does not rule on the merits. In the absence of a merits decision, the proceedings are terminated and may be declared cost-free (consid. 1).

Vu l'enquête n° PE08.027277-BDR instruite par le Juge d'instruction de l'arrondissement de Lausanne contre A.W.________ pour violation d'une obligation d'entretien, sur plainte de B.W., vu l'ordonnance du 25 mai 2009, par laquelle le magistrat instructeur a prononcé un non-lieu, frais à l'Etat, vu le recours exercé par B.W. contre cette ordonnance, vu les pièces du dossier; attendu que par lettre du 29 juin 2009, B.W.________ a déclaré retirer son recours, le Président du Tribunal d'accusation : I. prend acte du retrait du recours; II. déclare l'arrêt, rendu sans frais, exécutoire.
