W.________ appealed a Lausanne public prosecutor’s non-entry order of 14 December 2015. After being ordered to provide security for costs, he filed a letter stating that he was cancelling his opposition. Art. 386 al. 2 CPP Statuant sur le recours interjeté le 5 janvier 2016 par W.________ contre l’ordonnance de non-entrée en matière rendue le 14 décembre 2015 par le Ministère public de l’arrondissement de Lausanne dans la cause n° PE15.024647-ADY, la Chambre des recours pénale considère : E n f a i t e t e n d r o i t : 1.Par ordonnance du 14 décembre 2015, le Ministère public de l’arrondissement de Lausanne a refusé d’entrer en matière sur les plaintes datées du 22 novembre 2015 qu’avait déposées W.________ (I) et a mis les frais à la charge de ce dernier (II).
2 - 2.Par acte daté du 21 décembre 2015 déposé au greffe du Tribunal cantonal le 5 janvier 2016, W.________ a recouru contre cette ordonnance auprès de l’autorité de céans. Un délai au 27 janvier 2016, prolongé par la suite au 8 février suivant, a été imparti à W.________ pour effectuer un dépôt de 550 fr. à titre de sûretés. Par courrier du 7 février 2016 déposé au greffe du Tribunal cantonal le lendemain, W.________ a déclaré « annuler l’opposition » qu’il avait formée. 3.Le courrier précité devant être interprété comme un retrait du recours, il y a lieu d’en prendre acte et de rayer la cause du rôle. Le retrait du recours étant intervenu avant l'échéance du délai de paiement des sûretés, les frais de la procédure de recours, constitués en l'espèce du seul émolument d'arrêt, par 220 fr. (art. 422 al. 1 CPP et 20 al. 1 TFIP [Tarif des frais de procédure et indemnités en matière pénale du 28 septembre 2010; RSV 312.03.1]), seront laissés à la charge de l’Etat (art. 423 al. 1 CPP). Par ces motifs, la Chambre des recours pénale prononce : I. Il est pris acte du retrait du recours. II. La cause est rayée du rôle. III. Les frais de la procédure de recours, par 220 fr. (deux cent vingt francs), sont laissés à la charge de l'Etat.
